Other Misc. Rules Related to Firearms – Part 2

The last blog contained the first half of the miscellaneous rules related to firearms. This blog has the second half of the miscellaneous rules related to firearms. Keep in mind both lists cover the general rules/laws, please see the actual Penal Code for exact wording.

  • Discharge of a firearm at or near a/an: home, aircraft, dwelling, building or vehicle:
    • If Occupied – it is not legal for anyone to willfully and/or maliciously discharge a firearm at any inhabited building, occupied aircraft, inhabited dwelling or home, occupied vehicle or inhabited camper. This law is in accordance with Penal Code 246.
    • If Unoccupied – it is also illegal for any person to willfully and or maliciously discharge a firearm at an unoccupied aircraft, motor vehicle, building or dwelling. It is not illegal, or does not apply to an abandoned vehicle and unoccupied motor vehicle or building if the person has permission from the owner as long as it is otherwise lawful. This laws in accordance with Penal Code 247.
  • Discharge of a firearm from a motor vehicle – According to Penal Code 26100 any driver or owner of a vehicle who allows a person to discharge a firearm from their vehicle may be punished with up to three years imprisonment in a state prison. The reason, it is illegal for any person to maliciously and/or willfully discharge a firearm from a motor vehicle.

The next article/blog, which will be coming later this month, will cover firearms related to minors, followed by an article that will talk about persons who are ineligible to possess firearms. The conclusion of that article will complete the first round of topics related to basic firearm safety. Starting in February 2017, we will be covering an array of topics related to firearms, courses that can be taken for firearm training and/or certification, firearm safety, etc.
